On motion for leave, a resolution was introduced (originating in the Committee on Rules and reported with the recommendation that it be adopted), which was read by its title as follows:

H. C. R. , Requesting the Joint Committee on Government and Finance to appoint an interim committee to study the use of diesel equipment in underground coal mines.
Whereas, The Federal Mine Safety and Health Administration reports over 2,227 diesel units used in underground coal mines nationally; and
Whereas, The use of diesel equipment in underground coal mines increases nationally by approximately 130 units per year; and
Whereas, The use of diesel equipment offers many safety advantages and eliminates potential electrical fire and shock hazards from trolley wires and other electrical sources; and
Whereas, Use of diesel equipment in underground coal mines would enhance mine emergency capabilities and efforts; and
Whereas, Several West Virginia manufacturers make and sell underground diesel equipment; and
Whereas, The Mine Safety and Health Administration's equipment approval center is located in Triadelphia, West Virginia; and
Whereas, West Virginia University does research of dieselusage; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby directed to appoint a study commission composed of three members from each house, with no more than two members from the same political party, and three residents and citizens of West Virginia who have at least five years' experience each in the coal mining industry, appointed by the President of the Senate and Speaker of the House of Delegates and may select an underground coal mine in this State to use diesel equipment in said mine for the purpose of gaining experience with diesel usage in underground mines in this State; and, be it
Further Resolved, That the committee report to the Joint Committee on Government and Finance no later than the beginning of the regular session of the Legislature in 1996, on its findings, conclusions and recommendations, together with drafts of any legislation necessary to effectuate its recommendations; therefore, be it
Further Resolved, That the expenses necessary to conduct this study, to prepare a report and to draft necessary legislation be paid from legislative appropriations to the Joint Committee on Government and Finance.
